Effective Date

These Terms & Conditions (“Agreement”) apply to all Recruiting & Exposure, Brand Development, Athlete Advisory, Exposure Foundation, Recruiting Management, Brand Management, Athlete Development, evaluations, consultations, and related services provided by Elevex Sports (“Company” or “Elevex Sports”).

By enrolling in, purchasing, accessing, or participating in any Elevex Sports service, the athlete and/or parent or legal guardian (“Client”) agrees to the terms outlined below.

1. Purpose of Services
Elevex Sports provides athlete-focused recruiting guidance, exposure assistance, athlete branding, development support, and long-term athlete advisory services.

Services may include:

• Recruiting guidance and planning

• Exposure and visibility support

• Athlete branding assistance

• Social media guidance

• Recruiting profile assistance

• Highlight review and recommendations

• Communication guidance with coaches

• NIL preparation and education where permitted

• Athlete evaluations and assessments

• Transfer portal guidance

• General athlete advisory services

Elevex Sports is designed to help athletes improve organization, visibility, branding, preparedness, and long-term athletic positioning.

2. No Guarantees or Promises
The Client understands and agrees that Elevex Sports does NOT make promises, guarantees, warranties, or assurances regarding recruiting, branding, NIL, scholarships, exposure, or athletic outcomes.

Participation in any Elevex Sports service or program does NOT guarantee:

• College recruitment

• Scholarships

• Athletic offers

• Roster placement

• Playing time

• College coach communication

• NIL deals or compensation

• Brand partnerships

• Sponsorships or endorsements

• Social media growth

• Recruiting rankings

• Professional opportunities

• Financial compensation

• Athletic success
   

Participation in any program or service does not guarantee recruitment by any college, university, brand, sponsor, collective, or organization.
All recruiting, scholarship, NIL, and branding decisions are made independently by:

• College coaches

• Universities

• Athletic departments

• Compliance offices

• Brands and sponsors

• NIL collectives

• Third-party organizations
   

Elevex Sports does not control the decisions of colleges, coaches, brands, sponsors, recruiters, or athletic organizations.

The Client understands that recruiting and athletic outcomes depend on many factors including:

• Athletic performance

• Academic eligibility

• Character and conduct

• Work ethic

• Injury history

• Position demand

• Recruiting needs

• Timing

• Market conditions

• Compliance rules

• Social media presence

• Brand image
   

No communication, recommendation, evaluation, marketing material, website content, social media content, consultation, verbal statement, or service provided by Elevex Sports shall be interpreted as a promise or guarantee of recruiting, scholarships, NIL opportunities, endorsements, partnerships, exposure, or athletic success.

3. Exposure and Recruiting Disclaimer
The Client understands that exposure alone does not guarantee recruitment.
Elevex Sports may assist with visibility, exposure, recruiting organization, communication guidance, and branding strategies intended to help athletes improve their recruiting positioning.

However, Elevex Sports cannot guarantee:

• That coaches will respond

• That coaches will evaluate the athlete

• That programs will recruit the athlete

• That social media exposure will create opportunities

• That highlight content will be viewed

• That communication efforts will result in offers
   

Recruiting outcomes vary from athlete to athlete and remain subject to independent evaluations made by coaches and institutions.

4. NIL and Brand Development Disclaimer
Where permitted, Elevex Sports may provide NIL education, brand development guidance, and athlete marketing assistance.

The Client understands that Elevex Sports does NOT guarantee:

• NIL opportunities

• NIL compensation

• Sponsorships

• Brand deals

• Endorsement agreements

• Social media monetization

• Public recognition

• Influencer growth
   

Any NIL or branding opportunity depends on factors including athletic performance, marketability, social media engagement, audience reach, compliance approval, and third-party brand decisions.

All NIL opportunities remain subject to:

• NCAA rules

• State laws

• School policies

• Conference regulations

• Compliance department approval
   

Elevex Sports cannot guarantee approval by any institution, compliance office, sponsor, or brand.

5. Athlete and Parent Responsibilities
The athlete and/or parent or guardian agrees to:

• Maintain professionalism and respectful conduct

• Provide accurate information

• Communicate in a timely manner

• Maintain academic eligibility where applicable

• Follow school, NCAA, NAIA, NJCAA, conference, and state rules

• Participate actively in the recruiting and development process

• Maintain appropriate social media conduct
   

Failure to communicate, participate, or follow recommendations may negatively impact the effectiveness of services.

Elevex Sports is not responsible for lost opportunities resulting from:

• Missed deadlines

• Inaccurate information

• Academic ineligibility

• Injuries

• Team disciplinary issues

• Poor communication

• Social media misconduct
   

6. Compliance and Eligibility
Elevex Sports intends to operate in accordance with applicable high school association rules, state laws, NCAA rules, NAIA rules, NJCAA rules, conference regulations, and institutional policies where applicable.

The Company acknowledges that NIL laws, recruiting rules, athlete-agent regulations, and high school athletic policies vary by state and governing organization.

Elevex Sports will make reasonable efforts to follow and operate within applicable laws, rules, and regulations related to athlete representation, recruiting guidance, exposure services, branding, and NIL activities.

The Client understands that:

• Rules and laws vary by state

• Compliance standards may differ between schools and organizations

• NIL policies may change at any time

• Athletic associations may revise regulations without notice

• Certain services may be restricted in specific states or organizations
   

The Client is solely responsible for maintaining athletic and academic eligibility.
Elevex Sports does not provide legal advice and cannot guarantee NCAA, NAIA, NJCAA, high school association, state association, or institutional compliance determinations.
The athlete and family are responsible for confirming rules and eligibility requirements with:

• Athletic departments

• Compliance offices

• High school administrators

• State associations

• NCAA, NAIA, or NJCAA representatives

• Legal advisors where appropriate
   

Compliance rules and NIL laws may change at any time.

7. Third-Party Platforms and Services
Elevex Sports may utilize or recommend third-party recruiting tools, software systems, communication platforms, social media platforms, or exposure services.

Elevex Sports is not responsible for:

• Platform outages

• Technical failures

• Policy changes

• Third-party pricing changes

• Social media algorithm changes

• Account restrictions or suspensions

• Data loss or service interruptions
   

The Client understands that all third-party platforms operate under their own policies and procedures.

8. Payments and Billing
All program fees, consultations, subscriptions, deposits, monthly payments, annual payments, and evaluations are non-refundable unless otherwise stated in writing.
Failure to make payments may result in:
 

• Suspension of services

• Removal from programs

• Loss of access to services

• Termination of support
   

Chargebacks or payment disputes may result in immediate suspension or termination of services.

Elevex Sports reserves the right to modify pricing, services, and package structures at any time.

9. Intellectual Property
All materials created or provided by Elevex Sports remain the intellectual property of Elevex Sports unless otherwise agreed in writing.
This includes:

• Graphics

• Branding assets

• Recruiting templates

• Marketing materials

• Website content

• Program structures

• Social media content

• Digital resources
   

The Client may not reproduce, distribute, copy, or resell Elevex Sports materials without written permission.

10. Social Media and Conduct
The Client acknowledges that public conduct and social media activity may impact recruiting and branding opportunities.

Elevex Sports reserves the right to suspend or terminate services if the athlete engages in conduct that may negatively impact:

• The reputation of Elevex Sports

• Recruiting opportunities

• Brand relationships

• Partner relationships
   

This includes harassment, threats, illegal activity, repeated misconduct, fraud, or other unprofessional behavior.

11. Communication Consent
The Client authorizes Elevex Sports to communicate through:

• Email

• Phone calls

• Text messages

• Social media messaging

• Video conferencing

• Digital communication platforms
   

Communication may include scheduling, recruiting guidance, service updates, promotional information, payment reminders, and athlete development information.

12. Media Release
Unless otherwise requested in writing, the Client grants Elevex Sports permission to use the athlete’s:

• Name

• Image

• Likeness

• Photos

• Videos

• Graphics

• Testimonials

• Public athletic accomplishments

for promotional, recruiting, branding, website, portfolio, and marketing purposes.
The Client may revoke media consent in writing for future promotional use.

13. Independent Relationship
Participation in any Elevex Sports service does not create employment, partnership, or joint venture relationships.

The athlete and family remain responsible for all personal, athletic, academic, and recruiting decisions.

14. Evaluations and Recommendations
Any evaluation, recommendation, recruiting projection, ranking assessment, or development feedback provided by Elevex Sports is opinion-based analysis only.

Such evaluations are not guarantees of:

• Recruiting success

• Scholarships

• NIL value

• Athletic progression

• Future performance

• Market value
   

Athletic performance and recruiting value may change over time.

15. Transfer Portal Disclaimer
For athletes entering or considering the transfer portal, Elevex Sports may provide branding guidance, visibility support, and organizational assistance.
However, Elevex Sports does NOT guarantee:
 

• Transfer opportunities

• Scholarship increases

• Communication from schools

• Roster placement

• Recruitment by another institution
   

Transfer recruiting decisions remain entirely independent.

16. Limitation of Liability
To the fullest extent permitted by law, Elevex Sports shall not be liable for:

• Recruiting outcomes

• Scholarship decisions

• NIL outcomes

• Brand partnership decisions

• Financial losses

• Missed opportunities

• Athletic performance

• Injuries

• Eligibility determinations

• Third-party actions

• Indirect or consequential damages
   

Participation in services is voluntary and undertaken at the Client’s own discretion.
Any maximum liability of Elevex Sports shall not exceed the amount paid by the Client for services directly related to the claim.

17. Program Term and Reevaluation
Unless otherwise stated in writing, all Elevex Sports plans and programs operate on a twelve (12) month term beginning on the official enrollment or activation date.
Approximately one month prior to the expiration of the current plan, Elevex Sports may conduct a reevaluation of the athlete’s development, recruiting progress, branding progress, participation, communication, goals, and overall fit within the program.

Following reevaluation, Elevex Sports may:

• Offer continuation under a new plan

• Recommend a different level of service

• Recommend modifications to the athlete’s program structure

• Extend services under updated terms

• Decline renewal at the Company’s discretion
   

Continuation beyond the initial 12-month term is not automatic and may require a new agreement, updated pricing, updated services, or revised program terms.

The Client understands that Elevex Sports reserves the right to determine whether continued partnership or program renewal is appropriate based on the athlete’s participation, professionalism, communication, development, and overall alignment with the Company.

18. Service Modifications and Termination
Elevex Sports reserves the right to:

• Modify services

• Adjust pricing

• Change packages

• Update program structures

• Revise policies

• Suspend or terminate services
   

Services may be terminated for reasons including:

• Nonpayment

• Fraudulent activity

• Harassment

• Misconduct

• Reputational concerns

• Violations of policies

Termination does not automatically remove outstanding payment obligations.

19. Governing Law
These Terms & Conditions shall be governed by the applicable laws selected by Elevex Sports unless otherwise stated in a separate written agreement.

If any portion of this Agreement is determined to be unenforceable, the remaining provisions shall remain in effect.

20. Acceptance of Terms
By enrolling in services, submitting payment, participating in consultations, completing assessments, signing agreements, or continuing participation in Elevex Sports programs, the Client acknowledges that:

• They have read and understand these Terms & Conditions

• They understand there are NO guarantees of recruiting, scholarships, NIL opportunities, brand deals, endorsements, or athletic success

• They voluntarily agree to participate in services

• They understand recruiting and athletic outcomes depend on independent factors outside the control of Elevex Sports

• They agree to comply with these Terms & Conditions
   

Elevex Sports operates as a professional athlete advisory and development organization focused on recruiting guidance, branding, exposure assistance, athlete development, and long-term athlete support.
