Failure to Complete Deliverables

Payment of Compensation and Commission

Payment for services, playing contracts, endorsements, appearances, sponsorships, licensing, marketing agreements, NIL opportunities (if applicable), or any other compensation covered under this Agreement may be made directly to Elevex Sports or directly to the Athlete, as determined by the applicable third party, league, team, organization, or contracting entity.  If payment is made directly to Elevex Sports, Elevex Sports shall deduct the applicable commission(s) as set forth in this Agreement and remit the remaining balance to the Athlete within fourteen (14) business days after receipt of the funds, unless a different payment schedule is required by the paying entity, applicable law, or another provision of this Agreement.  If payment is made directly to the Athlete, the Athlete shall pay Elevex Sports the applicable commission(s) set forth in this Agreement within fourteen (14) business days after the Athlete's receipt of such payment.  The Athlete agrees to promptly notify Elevex Sports of any payment received directly by the Athlete that is subject to this Agreement and shall provide reasonable documentation of such payment upon request.  Any commission not paid within the required timeframe shall be deemed past due and shall constitute a material breach of this Agreement. Elevex Sports reserves the right to pursue all remedies available under this Agreement and applicable law to recover any unpaid commissions, including, where permitted by law, reasonable attorneys' fees, court costs, collection costs, and any applicable interest.

Commission Following Termination

Termination of this Agreement shall not affect Elevex Sports' right to receive commissions on any NIL opportunities (if applicable), sponsorships, endorsements, appearances, licensing agreements, marketing campaigns, partnerships, brand relationships, or other commercial opportunities that were introduced, sourced, negotiated, secured, or materially facilitated by Elevex Sports prior to the effective date of termination.  The Athlete agrees that Elevex Sports shall remain entitled to receive the applicable commission on any compensation earned from such opportunities, including renewals, extensions, or payments resulting from agreements entered into before termination, even if payment is received after this Agreement has ended.  This post-termination commission obligation shall remain in effect for six (6) months following the effective date of termination. After the expiration of the six (6)-month period, no further commissions shall be owed to Elevex Sports unless otherwise agreed to in writing by both parties.
